Libertarian Party of Nebraska Bylaws (Cont.)
Article VII -- PLATFORM
Section 1. The Party adopts the National Libertarian Party Platform. Said Platform shall include the implementation of the principles contained in the Statement of Principles in the form of planks.
Section 2. At a state convention the Platform may be amended by addition to any plank. Amendments must be made with the approval of not less than two-thirds vote of the members present.
Article VIII -- NOMINATION OF CANDIDATES
Section 1. Any candidate in a partisan election in the State of Nebraska running for election as a Libertarian shall be nominated at state convention of the Party or at an ad-hoc meeting specifically for candidate nomination.
Section 2. Nominations for candidates shall be approved by a majority vote of the members present.
Section 3. For purposes of nomination for candidates in this Article, members shall be defined as all Party members and any persons registered as Libertarian voters with the election officer of Nebraska.
Article IX -- DISCIPLINE
Section 1. Disciplinary actions against any Party member shall be in accordance with Robert's Rules of Order, except as otherwise provided herein by the Party Bylaws. Disciplinary action against any member shall consist of reprimand, suspension, or expulsion from the Party.
Section 2. A member shall be subject to disciplinary action for the following reasons (in addition to any previously mentioned herein):
a) Committing the Party to financial obligations without the consent of the Executive Committee, or
b) Making statements for the public record in the name of the Libertarian Party which may be only personal opinions, and which may prove objectionable or harmful to other members, and which are in direct violation of the Statement of Principles.
Section 3. No reprimand, suspension, or expulsion shall be valid against any member unless it is approved by a two-thirds vote of the members present at any ad-hoc or regularly scheduled meeting.
Article X -- BYLAWS
Section 1. The Executive Committee shall promulgate the Bylaws in accordance with applicable law.
Section 2. The Bylaws of the Party may be amended by a two-thirds vote of the members at any state convention or ad-hoc meeting called by the Party Chair.
Section 3. The membership may not amend the Bylaws of this organization so that they are in violation of the prevailing laws of the State of Nebraska or of the United States.
Article XI -- ELECTION AND REMOVAL OF OFFICERS
Section 1. The Chair, Vice-Chair, Secretary, Treasurer, and Communications Director shall be elected by nomination and majority vote of the members present during state conventions or during ad-hoc meetings called for by the Party Chair. Should more than two candidates seek any office, a run-off vote or votes will be taken with the candidate in each vote receiving the lowest number of votes eliminated, and run-offs then held between the remaining candidates.
Section 2. District Coordinators may be elected to assist Party leadership. A District Coordinator shall be a resident of, and represent the members from, each US Congressional District in Nebraska. The name of the District Coordinator for each district must be made known to the membership at the Convention.
Section 3. No persons may concurrently hold more than one of the offices except in cases of interim need, not to exceed 90 calendar days.
Section 4. Any of the elected officers may be removed from office for disciplinary reasons as stated in Article IX above; and also for nonperformance or negligent performance of duties of office.
Article XII -- ORGANIZATIONAL CONFORMANCE WITH THE NEBRASKA ELECTION CODE
The requirements of the Nebraska Election Code and any other pertinent statutes shall constitute a part of these Bylaws and shall supersede any conflicting provisions hereof.
Article XIII -- RESOLUTIONS
Resolutions are position statements made on current issues. Resolutions shall be submitted at an state convention and require a two-thirds vote of members. Resolutions shall sunset at the following state convention.
Article XIV -- DUES
Dues shall be set by the Executive Committee.
These Bylaws were approved by unanimous vote of the Executive Committee in accordance with Article V (MEETINGS) and Article X (BYLAWS) 6 March, 2010.
