Libertarian Party of Nebraska Bylaws
Article I
NAME AND PURPOSE
Section 1. The name of this organization shall be the Libertarian Party of Nebraska, hereafter referred to as the "Party."
Section 2. The purpose of the Party is to maintain a representative government that protects the inalienable rights of individuals. To that end, the Party shall:
a) Nominate candidates for partisan and nonpartisan office in Nebraska via convention
b) Support, to the extent possible, Party-nominated candidates
c) Pursue ballot access petitioning when necessary
d) Support local, state, and national efforts that further the purpose of the Party
Article II
OFFICERS, DISTRICT COORDINATORS, MEMBERS, DELEGATES, AND COMMITTEES.
Section 1. Officers. Officers of the Party shall be the Chairman (Chair), Vice Chairman (Vice Chair), Secretary, Treasurer, and Communications Director.
Subsection 1.1. Officers shall be active members of the National Libertarian Party.
Subsection 1.2. Officers shall comprise the Executive Committee.
Subsection 1.3. Officers shall be registered Libertarian voters in Nebraska so long as the Party is recognized by the Secretary of State or registered as Nonpartisans if the Party is not recognized.
Subsection 1.4. Officers shall be elected at a state convention of the Party that is chaired by the Chair (or Vice Chair in the absence of the Chair), held between January and June of even-number years, by a majority of the attending Delegates or, during meetings duly called to replace or fill Officer, District Coordinator or alternate positions. Officers shall take office immediately upon the close of such conventions or meetings and shall serve until replaced under the provisions set forth in these Bylaws. A majority of Officers cannot be replaced during one Party convention unless due to voluntary vacancy. The Chair shall be replaced every 2nd convention at a minimum.
Subsection 1.5. Officers are Delegates to the Party convention, each with one vote.
Subsection 1.6. Chair. In addition to other duties in these Bylaws, the Chair shall preside at all meetings, conventions, Executive Committee meetings, and shall be the chief executive officer of the Party. By appointment, the Chair shall fill all vacancies which occur in any delegation to a National Convention. If the Chair will be absent from any National Convention, the Chair will designate an Officer or District Coordinator to fill such vacancies and to represent the Party as Chair for the duration of the respective National Convention.
Subsection 1.7. Vice Chair. The Vice Chair shall preside at meetings in the event of the absence, resignation, or removal of the Chair until such time as a new Chair is elected. The Vice Chair shall serve as chief of staff of any paid employees, either permanent or temporary, of the Party. The Vice Chair will serve as chief of District Coordinators.
Subsection 1.8. Secretary. The Secretary shall be the recording Officer of the Party. The Secretary shall maintain complete and accurate records of all party conventions, meetings, and votes made therein. The Secretary, under the advisement of the Chair, shall be responsible for certifying all Party nominations to the Secretary of State or appropriate election officer in the district that the nomination appears.
Subsection 1.9. Treasurer. The Treasurer shall receive, expend, and account for the funds of the Party, ensure appropriate tax laws are complied-with by the Party, and ensure Generally Accepted Accounting Principles are adhered to by the Party. The Treasurer will not expend cash in excess of $100 in any transaction without written or digital approval from the Chair or Vice-Chair.
Subsection 1.10. Communications Director. The Communications Director will draft Press Releases, maintain mailing lists of Members, and will coordinate Party activities with the Chair and Vice Chair. The Communications Director will conduct those actions necessary to increase enrollment in the Party in accordance with the purpose of the Party. The Communications Director shall track and maintain membership lists, lists of others who indicate an interest in the Party, and shall notify each Member ten days prior to the expiration of his/her membership.
Section 2. District Coordinators. There shall be one District Coordinator and one alternate District Coordinator representing each Congressional District.
Subsection 2.1. District Coordinators and alternates shall be active members of the National Libertarian Party.
Subsection 2.2. District Coordinators and alternates shall be residents of the Congressional District they represent.
Subsection 2.3. District Coordinators and alternates shall be registered Libertarian voters in Nebraska so long as the Party is recognized by the Secretary of State or registered as Nonpartisans if the Party is not recognized.
Subsection 2.4. District Coordinators and alternates may serve on committees.
Subsection 2.5. Alternate District Coordinators may represent their respective district in the absence of the District Coordinator when duly appointed by the respective District Coordinator or by the Party Chair in the absence of the respective District Coordinator.
Subsection 2.6. District Coordinators shall be elected by a majority vote of Party Delegates present at conventions or meetings, duly called.
Subsection 2.7. District Coordinators shall coordinate activities within their respective district, maintain membership lists of district Party Members, and report to the Executive Committee upon request.
Subsection 2.8. District Coordinators and alternates are Delegates to the Party convention, each with one vote.
Section 3. Members. Party Members shall consist of all registered Libertarian voters in the State of Nebraska, active members of the National Libertarian Party, and Nebraska residents that indicate a desire to support the purpose of the Party.
Subsection 3.1. Members may be Delegates to the Party convention, once nominated, seconded, and approved by the Executive Committee, each with one vote.
Section 4. Delegates. Delegates serve as Party leadership during conventions.
Subsection 4.1. Delegates shall be active members of the National Libertarian Party.
Subsection 4.2. Delegates shall be registered Libertarian voters in Nebraska so long as the Party is recognized by the Secretary of State or registered as Nonpartisans if the Party is not recognized.
Subsection 4.3. Delegates will perform Party business during conventions under the Rules of Order established by the Executive Committee at time of convention.
Subsection 4.4. Delegates shall be nominated, seconded, and approved by the Executive Committee, at least 15 days prior to a convention duly called.
Section 5. Committees. Committees direct or manage the affairs of the Party in accordance with the Partys purpose.
Subsection 5.1. The Executive Committee shall be composed of the Officers of the Party and is chaired by the Party Chairman. The Executive Committee shall direct and manage all the affairs, properties, and funds of the Party consistent with these Bylaws and applicable state and federal laws and in accordance with the Partys purpose. The Executive Committee shall provide for legal service to the Party as needed. The Executive Committee will, by majority vote, fill Officer vacancies when needed. Vacancies may include, but are not limited to, vacancies created by illness, death, withdrawal, or disqualification of any Party Officer or District Coordinator or alternate.
Subsection 5.2. The Outreach Committee shall be chaired by the Party Vice Chairman and be comprised of two Officers and up to three District Coordinators and Alternates. The Outreach Committee shall conduct business so as to affect the branding of the Libertarian Party of Nebraska.
Subsection 5.3. Other Committees may, from time to time, be established by majority vote of the Executive Committee, duly called.
Section 6. It is the responsibility of all Officers, District Coordinators, and alternate District Coordinators of the Party to maintain contact with the Executive Committee and other Party leadership. Any Officer that will be out of contact for longer than 14 calendar days will notify any other Officer of the Party of that status prior to absence, barring illness. Any Officer that cannot be contacted for longer than 14 calendar days is subject to replacement. Any Officer that fails to attend two consecutive meetings duly called shall be requested to relinquish his or her position. If the Officer cannot be contacted after his or her second missed meeting, he or she is subject to removal and replacement in accordance with these Bylaws.
